Terms of Service

Rules for using AVATON, customer responsibilities, API authorization, intellectual property, service limits, and mandatory legal protections.

Effective 1 September 2026.

Agreement and service

These terms govern your use of AVATON, its website, APIs, MCP endpoints, documentation, and related services. By creating an account or accepting these terms, you agree to them on behalf of yourself or the organization you are authorized to represent. You must be at least 18 and able to enter a binding agreement. Contact: contact@avaton.dev. AVATON is an independent personal project. For service, legal, and privacy inquiries, contact contact@avaton.dev.

Effective date: 1 September 2026. The version presented when you accept these terms records the terms agreed for your use; later revisions do not retroactively change prior consent or create obligations for periods before acceptance.

Access, approval, and accounts

Account registration, email verification, and administrative approval are separate steps. Approval is discretionary and may be withdrawn for abuse, security concerns, legal obligations, or breach of these terms. Pending accounts can view guidance and personal settings but cannot use workspace or execution features. You are responsible for accurate account information, authorized team access, and safeguarding your login methods and tokens.

Only rights expressly granted by these terms are licensed to you. Your access is limited, revocable, non-exclusive, and subject to the applicable plan, documented API interfaces, quotas, and security controls. Do not share access to bypass these limits.

Your APIs, credentials, and instructions

You must own or have permission to use each API, credential, definition, data set, and destination configured in AVATON. You are responsible for the legality of instructions, lawful data processing, upstream provider terms, production changes, approvals, and any charges incurred at third parties. Test in staging before production and give credentials the minimum necessary permissions.

You retain rights in your submitted content and data. You grant AVATON only the rights needed to host, process, transmit, secure, and support that content to provide the service and comply with law. You must not submit another person’s secrets or confidential information without authority.

Acceptable use

Do not use AVATON for malware, credential theft, fraud, phishing, unlawful surveillance, denial of service, exploitation, harassment, or illegal content or transactions. Do not direct it at systems you are not authorized to access, internal or restricted network destinations, or endpoints designed to evade security controls. Do not bypass authentication, tenant boundaries, approval gates, rate limits, credential protections, or usage accounting.

Do not submit unlawful or infringing material, interfere with other users, resell unauthorized access, scrape private information, or probe the service without written authorization. Report security issues privately to contact@avaton.dev. We may block requests, suspend or terminate access, preserve evidence, or respond to lawful authorities when reasonably necessary.

Intellectual property and reverse engineering

AVATON and its licensors retain rights in the original software, interface, branding, documentation, and other protected materials. You may not copy, redistribute, impersonate, remove proprietary notices from, or create unauthorized derivatives of those materials.

Except where applicable law permits despite contractual restrictions, you may not reverse engineer, decompile, disassemble, extract non-public source code, circumvent technical protections, or use unauthorized access to obtain trade secrets. Legitimate statutory interoperability, security-research, and other mandatory exceptions are preserved. Third-party and open-source components remain governed by their own licenses.

These terms protect AVATON’s original expression, confidential information, and lawful intellectual-property rights. They do not claim ownership of general ideas, public standards, independently developed work, or your own APIs and data.

AI clients, upstream services, and operations

AVATON governs access to configured capabilities; it does not guarantee that an AI client will choose the correct action or that a third-party API is accurate, available, safe, or suitable. Review tool permissions, inputs, results, and production effects. Third-party services are independent and their terms and privacy practices also apply.

We do not routinely review every payload or guarantee the lawfulness of each customer-selected destination. This does not mean traffic is anonymous or that AVATON has no security records. We may investigate misuse or act on legal obligations. You remain responsible for authorized use; these terms do not exclude responsibilities that law places on AVATON itself.

Availability and changes

Early-access features may change, be limited, interrupted, or discontinued. Unless a separate signed agreement says otherwise, we do not promise uninterrupted availability, a service-level agreement, permanent free access, or fitness for a particular purpose. Maintain your own copies and recovery plans. Do not rely on early access for safety-critical operations or as your only control for financial, medical, legal, or other high-impact decisions.

Disclaimers and liability

To the extent permitted by law, the service is provided as available, without implied warranties of merchantability, fitness, or non-infringement. We do not guarantee the correctness of API definitions, generated tool schemas, execution results, or external providers.

To the extent permitted by law, neither party is liable for indirect, incidental, consequential, special, or punitive loss, including lost profits, business opportunities, or data. AVATON’s aggregate liability for claims arising from the service is limited to the greater of USD 100 or the amount you paid AVATON for the affected service in the preceding 12 months.

These exclusions and limits do not apply where prohibited, including liability that cannot lawfully be excluded for fraud, intentional wrongdoing, gross negligence, death or personal injury, or mandatory consumer and data-protection rights. If a limitation is invalid in your jurisdiction, it applies only to the maximum lawful extent.

Claims, suspension, and termination

If you use AVATON for a business, to the extent permitted by law you will defend and indemnify the operator against third-party claims arising from your unlawful content, unauthorized API use, or material breach, except to the extent caused by AVATON’s own wrongdoing. We will provide reasonable notice and cooperation and will not settle a claim imposing obligations on you without your consent.

You may stop using the service and request account closure. We may suspend or terminate for material breach, security risks, nonpayment under an agreed plan, or legal requirements, with notice and an opportunity to resolve the issue where reasonably possible. Suspension does not require disclosure of customer secrets to staff or third parties.

Disputes, mandatory rights, and updates

Contact contact@avaton.dev first so we can try to resolve a dispute. Courts with jurisdiction under applicable law remain available. No mandatory arbitration, class-action waiver, or waiver of EU consumer protections is imposed by this draft. Nothing prevents a regulator complaint or exercise of non-waivable rights.

We may update these terms with any notice and renewed acceptance required by law. A material change is not applied retroactively without a lawful basis. Invalid clauses do not invalidate the remaining terms. A separate signed agreement controls if it expressly overrides these terms.
